By accessing or using Garage Pass (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
3. User Accounts
To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. User Content & Public Profiles
The Service allows you to upload information about vehicles, including photos, modifications, and stories ("User Content").
- Ownership: You retain ownership of your User Content.
- License: By posting User Content, you grant Garage Pass a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.
- Publicity: You understand that Vehicle Profiles are public by design. Information you include in a public profile can be viewed and shared by anyone.
5. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose.
- Post content that is defamatory, obscene, abusive, or violates the rights of others.
- Interfere with the security or operation of the Service.
- Scrape or collect data from the Service using automated means without our permission.
- Impersonate any person or entity.
6. Intellectual Property
The Service (excluding User Content) and its original content, features, and functionality are owned by Garage Pass and are protected by copyright, trademark, and other laws.
7. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GARAGE PASS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE LAST SIX MONTHS.
10. Indemnification
You agree to defend, indemnify, and hold harmless Garage Pass and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
11. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Alabama, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in Alabama, except that either party may seek injunctive relief in court.
12. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting the new Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.
